YoCharge Terms of Use

These Terms of Use (“Terms”) govern your access to and use of YoCharge’s EV charging management platform, including CMS, mobile applications, websites, and associated services (“Platform”).
By accessing, registering, or using the Platform, or by clicking “I Agree”, you agree to be bound by these Terms.
1. Definitions
“Software” means YoCharge’s EV charging platform.
“Authorized User” means individuals permitted by you to use the Platform.
“Licensee Data” means data submitted or generated by you.
“Charging Data” means system-generated usage and operational data.
“Aggregated Data” means anonymized data derived from Platform usage.
2. License Grant
YoCharge grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Platform for internal business purposes.
3. Usage Restrictions
You shall not:
– Reverse engineer or decompile the Platform
– Copy or modify the Software
– Resell or sublicense access
– Use the Platform unlawfully
You are responsible for all Authorized Users.
4. Payments
Fees and billing shall be governed by separate commercial agreements. Non-payment may result in suspension.
5. Platform Services
YoCharge may update, maintain, and improve the Platform. Support is provided via email and ticketing systems.
6. Licensee Responsibilities
You are responsible for:
– Payment gateway setup
– Third-party services (SMS, email, OTP)
– Legal compliance
7. Data Ownership
7.1 Licensee Data
You retain ownership of your data. YoCharge may process it to provide services.
7.2 Charging Data
YoCharge owns Charging Data but grants you access to your relevant data.
7.3 Aggregated Data
YoCharge may use anonymized data for analytics and improvements.
7.4 Data Retention
Data may be retrieved for up to 90 days post termination.
8. Confidentiality
Both parties shall protect confidential information and not disclose it without consent.
9. Intellectual Property
All Platform IP remains with YoCharge. No ownership is transferred.
10. Disclaimer
The Platform is provided “as is” without warranties of any kind.
11. Limitation of Liability
YoCharge’s liability is limited to fees paid. No indirect damages shall be covered.
12. Indemnification
You agree to indemnify YoCharge against claims arising from misuse or breach.
13. Termination
YoCharge may suspend or terminate access for breach or non-payment.
14. Force Majeure
Neither party is liable for events beyond control.
15. Governing Law
These Terms are governed by Indian law. Jurisdiction: Udaipur, Rajasthan.
16. Changes to Terms
YoCharge may update these Terms. Continued use implies acceptance.
